Terms of Service

These Terms of Service (“Terms”) are a legal agreement between the person using the Services (“you”) and PawsPods LLC, doing business as Pawspods (“Pawspods,” “we,” “us,” or “our”). They govern the Pawspods mobile application, website, and related services that link to these Terms (collectively, the “Services”).

By creating an account, accessing, or using the Services, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Services.

If the Pawspods app is downloaded through Apple's App Store, its app license is also subject to Apple's Standard Licensed Application End User License Agreement. These Terms govern the Pawspods account and Services; Apple's Standard EULA governs the App Store license where applicable.

You must be at least 13 years old to use the Services. If you are under the age of legal majority where you live, you may use them only with the permission and supervision of a parent or legal guardian who agrees to these Terms. The Services are not directed to children under 13.

You may not use the Services if applicable law prohibits you from doing so.

You agree to provide accurate account information, maintain control of your email account and devices, and promptly notify Pawspods of suspected unauthorized access. You are responsible for activity through your account unless applicable law provides otherwise.

Pet ownership, co-owner access, and caregiver permissions may be used only for pets and households you are authorized to manage. You may not impersonate another person, falsely claim ownership of a pet, or invite someone to a household without authorization.

Pawspods provides tools for creating Pet Passports, saving Memories, organizing pet Care records, connecting pet profiles, discovering nearby pets and services, and creating or joining Playdates. Features may vary by device, location, account status, configuration, or release.

Pawspods may change, add, suspend, or discontinue features. We will provide notice when required by law, but do not promise that every feature will always be available.

“User Content” includes pet profiles, photos, captions, Memories, Care records, Playdate information, support messages, and other material a user submits to the Services.

You retain ownership of your User Content. You grant Pawspods a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt for technical formatting, display, and transmit it only as reasonably necessary to operate, secure, improve, and provide the Services according to your settings and instructions. This license ends when content is deleted from active systems, except where continued retention is permitted by the Privacy Policy or law.

You represent that you have the rights and permissions needed to submit User Content and that it and our permitted use do not violate law or another person's rights.

Our Privacy Policy explains how we handle information. You are responsible for choosing appropriate profile, Memory, discovery, location, family-access, and Playdate settings. Public or shared content may be copied or reshared by people who can access it.

Do not post a home address, private contact information, access code, financial information, or another person's personal information in public content.

You may not use the Services to:

• Break the law or encourage unlawful conduct.
• Harass, threaten, stalk, exploit, deceive, or harm another person or animal.
• Post hateful, abusive, sexually exploitative, fraudulent, defamatory, or unlawfully discriminatory content.
• Infringe intellectual-property, privacy, publicity, or other rights.
• Falsely represent pet ownership, identity, care qualifications, provider affiliation, attendance, or an emergency.
• Scrape, harvest, probe, reverse engineer, interfere with, overload, or bypass security or access controls, except where a restriction is prohibited by law.
• Upload malware or use automated systems without written permission.
• Use another pet's or person's nonpublic information for advertising, profiling, harassment, or unrelated purposes.

We may remove content, restrict features, or suspend accounts when reasonably necessary to enforce these Terms, protect users or animals, comply with law, or protect the Services.

Pawspods Care tools organize information supplied by users. Pawspods is not a veterinary practice, and the Services do not provide diagnosis, treatment, medical advice, or emergency services. Content, reminders, suggestions, and records may be incomplete, delayed, or inaccurate and must not replace advice from a qualified veterinarian.

If an animal may be experiencing an emergency, contact a veterinarian or local emergency veterinary service immediately.

Pawspods does not supervise Playdates, verify every member, guarantee pet temperament or eligibility, or control a host-selected location. You are responsible for deciding whether an event, location, person, or animal is safe; supervising pets and minors; following leash, vaccination, licensing, venue, and local-law requirements; and leaving an unsafe situation.

Participation conditions and host descriptions are informational unless expressly stated as automatically verified. Pawspods is not a party to arrangements between members.

The Services may display Apple Maps information or link to providers, websites, phone numbers, booking pages, map applications, or other third-party services. Pawspods does not control or guarantee a third party's availability, qualifications, licensing, prices, hours, services, safety, or listing accuracy.

Opening, contacting, visiting, booking with, or purchasing from a third party is at your discretion and may be governed by separate terms and policies. Pawspods is not a party to those transactions unless expressly stated otherwise.

The Services, software, designs, text, graphics, trademarks, logos, and other Pawspods materials—excluding User Content—are owned by PawsPods LLC or its licensors and protected by law. Subject to these Terms, Pawspods grants you a limited, personal, revocable, non-exclusive, non-transferable license to use the Services for their intended personal, noncommercial purpose.

If you voluntarily provide ideas or feedback, you grant Pawspods a perpetual, worldwide, royalty-free right to use that feedback without restriction or compensation. This does not transfer ownership of User Content.

You may stop using the Services at any time and may request account deletion as described in the Privacy Policy. Deleting the app does not itself delete an account or server-stored content.

We may suspend or terminate access if we reasonably believe you materially violated these Terms, created risk or legal exposure, harmed users or animals, or used the Services fraudulently or unlawfully. Where appropriate, we will provide notice and an opportunity to appeal by contacting will@pawspods.com.

Sections that by their nature should survive termination—including ownership, disclaimers, limitations, indemnity, disputes, and accrued obligations—will survive.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” PAWSPODS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND QUIET ENJOYMENT.

Pawspods does not warrant that the Services will be uninterrupted, secure, error-free, or free from harmful components, or that content, reminders, maps, provider information, or community information will be accurate or available. Some jurisdictions do not allow certain disclaimers, so some of this section may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAWSPODS AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, GOODWILL, PROFITS, OR OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICES.

To the maximum extent permitted by law, Pawspods' total liability for all claims arising from or related to the Services will not exceed the greater of the amount you paid Pawspods during the 12 months before the event giving rise to the claim or US $100. These limitations do not apply where prohibited by law.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Pawspods and its members, officers, employees, contractors, and agents from claims, damages, losses, and expenses, including reasonable attorneys' fees, arising from your User Content, misuse of the Services, violation of these Terms, or violation of another person's rights. This does not require indemnification for Pawspods' own unlawful conduct and does not apply where prohibited by law.

These Terms are governed by Wyoming law, without regard to conflict-of- law principles, except where the law of your residence requires otherwise. Subject to applicable consumer-protection law, unresolved disputes will be brought in state or federal courts located in Wyoming, and the parties consent to those courts' personal jurisdiction.

Before filing a claim, you and Pawspods agree to make a good-faith effort to resolve it by written notice to will@pawspods.com. This does not limit urgent injunctive relief or eligible small-claims proceedings.

We may update these Terms as the Services or law changes. We will post updated Terms here and revise the “Last updated” date. If a change is material, we will provide additional notice when required. Continued use after updated Terms become effective constitutes acceptance to the extent permitted by law.

These Terms, the Privacy Policy, and additional terms expressly presented for a feature form the agreement regarding the Services. If a provision is unenforceable, it will be modified to the minimum extent necessary and the rest remains effective. Failure to enforce is not a waiver. You may not assign these Terms without written consent; Pawspods may assign them in a reorganization, merger, acquisition, or asset sale. Headings are for convenience only.
